Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, products, and services (collectively, the "Services") provided by RosterOS, LLC ("RosterOS," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent. By using the Services, you represent and warrant that you meet these requirements.

To access certain features, you may be required to register for an account. You agree to provide accurate and complete information, keep your credentials secure, and notify us immediately of any unauthorized access. You are responsible for all activity under your account.

3. Waitlist and Access

Submitting your information to our waitlist does not guarantee access to the Services. Access is granted at our sole discretion, typically through private cohorts. We reserve the right to accept, decline, or defer any waitlist application.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, software, workflows, AI voice configurations, and automation sequences — are the exclusive property of RosterOS or its licensors and are protected by intellectual property laws.

Your data: You retain ownership of all data you provide to us. We do not claim ownership of your contact lists, business data, or lead information processed through our systems.

Deployments: Workflows, sequences, and configurations built for your account are yours. If you terminate service, you retain the right to continue operating the infrastructure deployed on your behalf, as outlined in your service agreement.

6. Fees and Payment

Pricing is presented during the access conversation. By subscribing to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as expressly stated in your service agreement or required by law. We reserve the right to modify pricing with 30 days' advance notice.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the engagement. This includes but is not limited to business strategies, pricing structures, technical configurations, and customer data. This obligation survives termination of the agreement.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

We do not guarantee specific results from the use of our Services. Metrics such as lead response times, conversion rates, and agent acquisition numbers may vary based on market conditions, your existing operations, and other factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, RosterOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless RosterOS, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.

11. Termination

Either party may terminate the service relationship in accordance with the terms of the applicable service agreement. We reserve the right to suspend or terminate your access to the Services immediately if you breach these Terms. Upon termination, your right to use the Services ceases, but provisions that by their nature should survive (including intellectual property, confidentiality, limitation of liability, and indemnification) will remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
